General Information
These General Terms and Conditions settle the relationships between online store BOGDAR as a seller, on one hand, and the users of the services available at the bogdar.com domain (hereinafter referred to as the Website) (in particular, the purchase of products from the online store) as a buyer, on the other.
These General Terms and Conditions are binding for all clients/buyers/users of the BOGDAR online store. Any use of the Website means that you have carefully read and understand the General Terms and Conditions for its use, that you have fully accepted them, and that you agree to respect them unconditionally. We recommend you to also carefully read the Website's Privacy Policy.
BOGDAR reserves the right to make unilateral changes, updates and amendments at any moment of these General Terms and Conditions, where their publication shall be deemed official notice to the users about the changes that have been made. Therefore, we would like to ask you to regularly check the content of this document. For any deal made via the Website, the General Terms and Conditions in force are those that have been in force at the moment the deal was made remotely between the Buyer and the Seller.
If any of the regulations set out in these General Terms and Conditions for the use of the Website turns out to be void or inapplicable, regardless of the reason, this shall not result in the invalidity or inapplicability of the rest of the regulations.

Registration
From BOGDAR you can place an order as a "guest" or by registering as a Website user. Please bear in mind that registration will make your future purchases easier and faster.
To register and become a Website user, you should take the following steps:
Click on the "Account" link;
Fill in the mandatory fields in the "Create Account" form. To register, you need to enter your first name, family name, valid email address and individual password*. After filling in all the required data in the mandatory fields, click on the "Create" button.
*In case you have forgotten your password, you can recover it through the "Account" section by clicking on the "Forgot your password?" button and entering the email address you have provided in your registration form. The Website will automatically generate a message containing a link to the Website to create your new individual password, which will be sent to your email address.
After you have confirmed your profile data, we will send a confirmation email to your email.
Orders
You can make orders from BOGDAR 24/7, including on weekends and official holidays. Your order will be processed on the first possible business day as per the official working calendar of the Republic of Bulgaria.
To purchase an item from the Website online, you need to make the following steps:
- Choose the item (product) you would like to buy from BOGDAR's product catalogue and also select the size and color of the item (product) you have chosen.
- Click on the "Add to cart" button. If you want to continue shopping by choosing other items (products), close the "Your cart" section by clicking on the "x" button. The first item/product you have selected and all other items/products will be automatically saved by the system until you decide to check out;
- If you want to check out, open the "Your cart" section and click on the "shopping cart" symbol button in the upper right corner. Then click on the "Checkout" button;
- Before finalizing your order, you can review your items/products, as well as all shipping and contact details. If necessary, you can correct or update this data;
- Choose your identification method in the "Customer information" section. If you choose the PayPal option, your shipping information (first name, family name, address and telephone number) will be generated automatically based on the data you have entered in the PayPal platform. If you choose the alternative option to manually fill in the respective fields with your shipping details, you should enter the required data in the respective fields, including your names, address and telephone number;
- After you have correctly filled in your shipping info, click on the "Continue to shipping method" button;
- Since all deliveries made by BOGDAR are free, the default shipping option in the "Shipping method" section is "Complimentary – Free" and cannot be changed;
- Move on to the next step in placing your order by clicking on the "Continue to payment method" button;
- Choose your payment method of choice (see section "Order Price and Payment Method" below);
- In the "Payment method" section, you will find a subsection called "Billing address" containing the data BOGDAR will use to issue an invoice for your purchase. In the "Billing address" subsection, the shipping info entered by you is set by default, but you can change it by clicking on the "Use a different billing address" button, which will activate an option containing fields where you can enter a different first name, family name, address and phone number. BOGDAR will enter the new data in your purchase invoice.
- After you have correctly filled in your payment method data, you can complete your order by clicking on the "Complete order" button.
- You will be notified by email (at the email address you have provided) about the confirmation of your purchase/purchases and sending this purchase/purchases to the shipping address you have provided.
- In case you don't receive a purchase confirmation email, please get in contact with us via mail indicated in the General Information in these General Terms and Conditions.
- You can delete any item/product from your shopping cart before the order gets processed;
- If you want to change an order that has already been processed, please get in touch with us by email or telephone as per the instructions set out in the General Information section of these General Terms and Conditions. Any changes and cancellations of orders that have already been processed are only possible before the items (products) have been dispatched via courier.
- You can check the status of your order by clicking on the respective email confirmation link that we have sent to you.
Any order, which has been filled in correctly and sent via the Website, is a binding proposal for entering into a remote purchase agreement with BOGDAR in line with these General Terms and Conditions and the regulations of the Bulgarian legislation currently in force. The purchase contract between BOGDAR and the Website users is made based on a proposal by the provider to the user as part of a product sale system, where – from the moment of making the offer until the singing of the agreement, as well as during the period of validity of the agreement, the parties are not in any physical contact with each other. Such contract is a remote sale contract under the regulations of the Bulgarian Law on Consumer Protection. The sale contract itself is made by BOGDAR and is deemed valid even after the respective items/products have been dispatched to the receiver.
You can make item (product) purchases from the Website both on the territory of the Republic of Bulgaria and from other EU and EEA member states, as well as from the territory of the United States of America. The shipping costs are fully covered by BOGDAR. For shipping outside the territory of the Republic of Bulgaria, BOGDAR is not responsible for the delivery periods, which in such cases are in line with the practices of the respective shipping company.
By placing an order, you oblige and are held responsible for making sure that all data you have provided to BOGDAR in relation to the order is correct, full and accurate as of the date the order has been dispatched. By placing the order, you give BOGDAR your permission to provide your data to the respective vendor, used by BOGDAR to complete the order (see section "Shipping on the territory of the Republic of Bulgaria", respectively "International Shipping" below).
The purchases made on the Website are fully secure. We guarantee the security of your personal data in strict compliance with the General Data Protection Regulation (EU) 2016/679) https://www.cpdp.bg/?p=element&aid=991 and the applicable Bulgarian legislation (for more information, please see the Website's Privacy Policy).
Order price and payment methods
The final amount payable by the user/buyer is the sum of all separate items/products ordered by the user. The end prices of the items/prices on the Website are in euros (VAT included) and include any and all other taxes and fees payable under the law.
The price and payment method are indicated in each order.
Payment methods:
- Payment via PayPal – BOGDAR accepts payments for the items (products) you have selected via the PayPal platform, which processes all personal data as assigned by BOGDAR. This provider fully processes all payments made by the Website users/buyers. - Payment by debit or credit card - BOGDAR accepts payments for the items (products) you have chosen using the following bank cards: Visa, VisaElectron, Maestro, MasterCard, etc. where the payments are administered by a third party – PayMill, with which BOGDAR is in a contractual relationship (PayMill processes personal data based on an assignment by BOGDAR, where the process guarantees the highest levels of user personal data protection, for more information, please visit: https://www.paymill.com/en/privacy-policy/).
In terms of online payments, BOGDAR does not assume any responsibility for any costs related to fees, commissions or other extra payments made by you or your bank as part of the transaction, or currency exchange costs that may be charged by the client's bank card issuer in the cases, where the currency is other than EUR. Some banks charge extra fees when a card payment to BOGDAR is treated as an international payment by your bank in line with its card payment rules for such transactions. The costs relating to such payments are fully covered by you.

These General Terms and Conditions are regulated by the Bulgarian legislation. In the event of any disputes between a user and Bogdar, these disputes shall be settled in the spirit of mutual understanding and compromise. If impossible, the competent authority to resolve any possible disputes shall be the Bulgarian court, applying Bulgarian legislation.
This privacy policy aims to give you information on how the company, which owns the website https://www.bogdar.com (hereinafter referred to as The Website) – Bogdar EOOD, UIC 203030285(hereinafter referred to as Bogdar) treats (collects, processes, stores, shares, etc.) your personal data and how you could control your preferences and settings in relation to this treatment. Furthermore, this Privacy Policy is fully in line with the provisions of the General Data Protection Regulation (GDPR) 2016/679, currently in force within the European Economic Area (EEA). The Website has been built fully based on the functionalities, available via the e-commerce platform Shopify (https://www.shopify.com/), which allows traders to create their own unique online store using the available models, codes and designs and combining them as they find appropriate. The relationships between Bogdar and Shopify are commercial and have been settled through a business agreement (General Terms and Conditions). Therefore, Bogdar and the Website, as well as all applicable rules in relation to the processing of the Website users'personal data, are closely bound to Shopify's rules, which also determines the circumstance that this Policy contains references and links to the policies, adopted and implemented by our partner Shopify, which we have in turn adopted and implemented in our operations.
Generally and above all, we should note that Bogdar collects and processes your personal data for the following purposes: (1) to fulfil our obligations as a seller of women's fashion clothing and accessories; (2) to deliver the Website's functionalities in the fullest and most efficient way possible; (3) to deliver information, products and services explicitly requested by our customers (for example, sending out newsletters, etc.); (4) to perform market analysis and statistical research for the purpose of internal marketing and statistical activities relating to Bogdar.
I. Section One – Registered website users data we collect
For clarity purposes, below you will find lists of the respective types of personal data Bogdar collects from the Website users, arranged based on the specific purposes and processes whose implementation requires the collection of personal data, namely:
- Personal data needed for user registration – data provided by the users when they register on the Website as indicated in the Website's General Terms and Conditions, in particular: (1) first name and (2) family name of the user; (3) valid email address; and (4) individual password for each individual user. In addition and solely by their own discretion, upon completing their registration, Website users can also add to the data listed in their Website profile (5) their address.
- Personal data needed for shipping purchased items – (1) first name and (2) family name of the user; (3) valid email address; (4) telephone number to contact the user and (5) delivery address.
- Personal data relating to payments made by the user – Bogdar uses two payment systems to support online payments. In particular, these systems are maintained by the third entities listed below and the respective data, collected when these systems are used, is as follows:
- PayPal (https://www.paypal.com/bg/home) – this provider fully processes all payments made by the Website users/buyers, where all banking and financial data (respectively credit and debit cards, including data thereof, etc.) are processed solely by this entity.
- PayMill (https://www.paymill.com/en/) – this third entity is a provider of online verification (confirmation) services relating to online payments. When collaborating with this provider, Bogdar receives access to the following banking and financial information about its Website users – (1) first name and (2) family name of the user; (3) type of bank card; (4) the last four digits of the bank card number; and (5) bank card validity data.

IV. Section 4 – Who do we share your personal data with
Sometimes we share your personal data with third parties. This is aimed at providing you with the best possible experience when using our Website, and sometimes – to secure and make available our service in general.
Bogdar does not grant usage rights, and does not sell, reveal or share your information (personal data under GDPR) with other entities or non-related companies, unless this is necessary to provide you with the services you requested and you have given your permission, or in any of the following hypotheses:
- Information is provided to our trusted partners working on assignments made by Bogdar based on contractual relationships and under confidentiality agreements. This third-party entities include, but are not limited to:
- Shopify (agreement) – we provide them with the following user data: first name, family name, email address, delivery address, and contact phone number. Thus, the provided information is used to administer the orders, prevent fraud (including personal data fraud), for authentication of registered users who have forgotten their individual passwords or user names, and to improve the services offered by the Website and the Shopify platform. - Paypal (agreement) – Bogdar accepts payments by credit and debit cards (as set out in the Website's General Terms and Conditions) for the items you have selected and purchased, where payments are fully administered by a third entity – PayPal based on an agreement (PayPal processes personal data based on assignments made by Bogdar, where the process guarantees the highest level of user personal data protection, for more information, please visit:

When collaborating with this provider, Bogdar receives access to the following banking and financial information about the Website users – (1) first name and (2) family name of the user; (3) type of bank card; (4) the last four digits of the bank card number; and (5) bank card validity date. - Klarna (agreement) - In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. - Shipping companies (agreements) – for the purpose of shipping the items, ordered via the websites, and to return these items to Bogdar (in line with all the terms and conditions described in the Website's Terms and Conditions):

- Bdintex Ltd. (agreement) – the company providing sewing services to Bogdar. The company is fully responsible for all requests to shipping companies in terms of the shipping and return of goods purchased via the Website, where in the course of delivering these services Bogdar shares with Bdintex information about the first names, family names, delivery addresses and contact phone numbers of its users.
- Dimana AD (agreement) – a company providing accounting services for Bogdar;

- Facebook Tracking Pixel (https://www.facebook.com/privacy/explanation)
- Mailchimp – we exchange user first names, family names and email addresses with this third entity for the purpose of securing functionalities (https://mailchimp.com/legal/privacy/).
- Information needed to fulfil our legal obligations based on legitimate requests coming from authorized government authorities, including but not limited to judicial authorities; investigative authorities; tax authorities, etc. (under the Law on Electronic Communications, The Criminal Code, the Law on the Ministry of Interior, the Law on the Judiciary, etc.)
If you do not wish us to send the information to some of our partners, you can withdraw your consent by contacting us in any of the ways indicated at the bottom of this Policy.
V. Section 5 – Personal Data Protection
Bogdar shall maintain appropriate technical and organizational measures to guarantee the security of all Website user data in line with all mandatory requirements of the applicable EU and Bulgarian law.
All your personal data we receive is processed in Ireland by the e-commerce platform Shopify and is stored on Shopify servers physically based in the US/Canada.
We limit any access to your information by employees or third-party vendors, working on assignments and under the control of Bogdar, where the main support of the Website is provided by our partner Sofia Moscow London Ltd.
This Website uses HTTPS-encrypted connection and Shopify certificates.
VI. Section 6 – Data transfer outside EEA
Bogdar does not perform direct user personal data transfer to countries outside the EU and the EEA.
Some of our partners may transfer data outside the EEA, when a decision has been made in terms of the adequate level of protection, for example – in the case of the EU-US Privacy Shield. For more information, please see our partners' privacy policies.
VII. Section 7 – How long we store your personal data
Data storage continues for as long as we have a reason to store the data. For example – a user has agreed for us to collect and process their information or has a profile on the Website.
Generally, the period after which we will delete the data used to purchase an item via the Website, including to return this item, is six months after the last activity in relation to the particular case.
For the purposes of measuring user behaviour on the Website, we store personal data based on the period of validity of the respective cookie recording.
VIII. Section 8 – Data subject rights under GDPR
- Right of access to your personal data – you have the right to receive confirmation from us as to whether we process your personal data and, if this is the case, you have the right to access your personal data and information.
- Right of rectification of personal data: if you discover that the personal data we process on you is incorrect, you have the right to make us correct this personal data.
- Right of erasure of personal data (the right to be forgotten): under certain circumstances, if your personal data is processed illegally or you have withdrawn your consent (if the personal data processing is based on consent), you have the right to request and receive erasure of your personal data by us.
- Right to restrict processing: under certain circumstances, for example if you doubt the accuracy of your personal data or have objected our legitimate goal for processing your personal data, you have the right to request us to restrict the processing of your personal data until a solution is found.
- The right to object: under certain circumstances, for example if you doubt our legitimate interest in processing your personal data, you have the right to object such processing based on reasons related to your particular situation.
- Right to data portability: if your personal data is processed automatically based on your consent or for the purpose of performing our contractual obligations, you have the right to request us to provide you with your personal data in a machine-readable format to transfer them to another data controller.
- Right to lodge a complaint with a supervisory authority: you have the right to lodge a complaint in terms of the processing of your personal data by us with the respective competent supervisory authority under the legislation of the Republic of Bulgaria and under Chapter VI of the GDPR or any other applicable EU regulation or international agreement. The competent supervisory authority in the Republic of Bulgaria is the Personal Data Protection Commission.
IX. Section 9 – Miscellaneous
This Privacy Policy is an integral part of the General Terms and Conditions in force for the services, available on the Website. It should be interpreted in relation to them in terms of purchasing products from the Website.
In the event of any disputes between a user and Bogdar, these disputes shall be settled in the spirit of mutual understanding and compromise. If impossible, the competent authority to resolve any possible disputes shall be the Bulgarian court, applying Bulgarian and EU legislation applicable as of the moment of resolving the problem.
Bogdar reserves the right to make changes to this Privacy Policy at any given moment by publishing the changed terms and conditions on the Website. In this case, you will be asked to accept the changed Privacy Policy once again.
